Avis Rental Car Reported as Stolen – Gunpoint Police Stop
A recent lawsuit filed by Whitney, LLP alleges that Avis Rent a Car rented a vehicle to our clients at BWI airport that was a rental car reported as stolen, leading to a traumatic, nightmare police stop when they were ordered out of the car at gunpoint. Consumers trust rental car companies to provide safe, reliable vehicles. Unfortunately, some customers have faced terrifying situations when a rental car reported as stolen was given to them, including sometimes facing rental car wrongful arrest. This blog discusses allegations made in the lawsuit and other general topics regarding stolen rental car claims and Whitney, LLP’s experience handling these claims and recovering compensation. AVIS has not admitted liability.

Allegations in the Avis Stolen Rental Car Lawsuit
According to the complaint filed in the Circuit Court for Anne Arundel County, Maryland, our clients rented a vehicle from Avis at Baltimore-Washington International Airport (BWI) after flying in from out of state. Unknown to them, the vehicle was allegedly a rental car reported as stolen by a prior customer who had called law enforcement.
While driving in Pennsylvania, police officers pulled our clients over, drew their guns, and ordered them out of the car at gunpoint. They were handcuffed, separated, and interrogated on the side of the road — a traumatic experience that resembled a rental car wrongful arrest. It was a traumatic experience through no fault of their own.
The lawsuit alleges violations of the Maryland Consumer Protection Act, negligent misrepresentation, and negligence.

Rental Car Wrongful Arrest — A Growing Concern
We have found there are generally three main types of these claims. Read more about these and your legal rights after being falsely accused of stealing a rental car in another Whitney, LLP blog.
-
Rented a car already reported as stolen, and stopped or arrested;
-
Stopped or arrested while driving the rental car due to it being reported stolen during the lawful rental; and
-
Stopped or arrested weeks, months or years after returning the rental car.
Being stopped by police while driving a rental car reported as stolen can quickly turn into a rental car wrongful arrest. Even when the customer has a valid contract, law enforcement officers may treat them as suspects until the confusion is resolved. This creates an unnecessary and avoidable risk of danger to both the rental car customers as well as law enforcement.
Rental car companies operate in different states, with huge inventory turnover and often are scrambling to keep up on a daily basis. In the midst of this confusion, their policies and procedures can get ignored, leading to customers suffering harm.
Our clients allege they were humiliated and terrified when police treated them as criminals, despite having done nothing wrong. This type of rental car wrongful arrest is not only emotionally devastating but also dangerous, as police encounters at gunpoint can escalate without warning. Some victims who were driving, or driving in, a rental car reported as stolen and were pulled over by law enforcement experience PTSD.

Alleged Misconduct by Avis
The allegations against Avis include:
- Renting out a rental car reported as stolen to unsuspecting customers.
- Failing to have and/or follow procedures to ensure that rental cars provided to customers are not reported stolen.
- Failing to confirm whether the vehicle was cleared from theft databases before re-renting it.
- Failing to disclose that the vehicle was a rental car reported as stolen at the time of the transaction.
- Exposing customers to the imminent danger of a rental car wrongful arrest during police stops.
Emotional and Financial Harm
Our clients allege that they suffered:
- Fear, humiliation, and trauma from being ordered out of a rental car reported as stolen at gunpoint.
- Sleeplessness, headaches, anxiety, and ongoing stress.
- Embarrassment in front of bystanders who saw what appeared to be a rental car wrongful arrest.
- Economic damages from dealing with the aftermath of Avis’s alleged negligence.

Compensation for Victims of Rental Car Reported as Stolen
Victims who were pulled over in a rental car reported as stolen or subjected to a rental car wrongful arrest may be entitled to significant financial recovery from the rental car company. Compensation is designed to address both the emotional trauma and the financial impact of the incident. Depending on the facts of the case, damages may include:
-
Emotional distress and mental anguish — for fear, humiliation, anxiety, and lasting psychological trauma.
-
Embarrassment and reputational harm — especially when the wrongful stop or arrest occurred in public view, or it was recorded by other citizens.
-
Economic losses — such as missed work, travel disruptions, or out-of-pocket expenses caused by the incident.
-
Medical expenses — for treatment of resulting physical injury, exacerbated pre-existing injury, stress-related conditions, headaches, PTSD, or other resulting conditions.
-
Attorney’s fees and court costs — recoverable under certain state laws, including the Maryland Consumer Protection Act, in successful claims.
-
Punitive damages — in cases of reckless or intentional conduct by the rental company, to punish and deter future misconduct.
By filing a lawsuit, consumers can seek justice and hold rental car companies accountable for dangerous and negligent practices.

Other Consumers Reporting Similar Experiences
Unfortunately, other consumers have described being given a rental car reported as stolen and later pulled over by police. In some cases, the incident escalated to a rental car wrongful arrest, with innocent people detained, handcuffed, or even jailed because of a rental company’s failure to clear stolen vehicle reports.
These incidents show that the risk of a rental car wrongful arrest is not hypothetical — it happens to consumers across the country.
When rental car wrongful arrest or wrongful traffic stops happen, rental car customers have significant legal rights and can fight back.
