Evicted After Paying Rent? Fight Back and Sue Them

If you were evicted after paying your rent in Maryland, you have legal rights and may be able to fight back, sue your landlord and recover significant compensation.  Maryland law allows tenants to pay their rent late and avoid eviction.  Even though Maryland law provides strong protections against illegal evictions, many landlords ignore these rules.  As a result, tenants are often left humiliated, embarrassed, upset and with damaged and stolen property after being evicted despite paying their late rent in full.

Whitney, LLP’s Maryland illegal eviction lawyers have experience successfully representing tenants who were illegally evicted, including after paying their rent late or after the landlord went to court and got a judgment.  Tenants should be aware that dishonest landlords often will try and settle illegal eviction cases for much less than these cases can be worth, such as offering a month of free rent or a few hundred dollars or few thousands dollars.  When landlords make these offers, they are not being kind or helpful – they are trying to avoid paying much more once the tenant hires an experienced illegal eviction lawyer.

Whitney, LLP’s illegal eviction lawyers have recovered significant compensation for victims of illegal evictions in Maryland, including but not limited to:

  • $275,000 settlement after a landlord mistakenly evicted the wrong apartment.
  • $225,000 for a tenant who was evicted after paying her rent late and some of her personal items were discarded.
  • Over $100,000 for a woman evicted before the Court issued an Order allowing the eviction, and who lost some of her personal property.
  • $70,000 settlement for a tenant locked out by their landlord and some of their property discarded before their lease was over.

Of course, all cases are different and past results do not guarantee future results.

A Maryland Petition for Warrant of Restitution, which a landlord must file as part of the process for evicting a tenant for late rent payments

Maryland’s Right of Redemption for Paying Rent Late to Avoid Eviction

In Maryland, after a landlord wins a rent court case, they can request a Warrant of Restitution to schedule an eviction. Prior to the eviction, tenants have the right of redemption—the ability to stop the eviction by paying the full judgment (unpaid rent plus court costs).

However, some tenants are evicted even after paying rent when landlords fail to notify the sheriff or constable to stop the eviction, when mistakes are made in paperwork, or when landlords attempt illegal “self-help” evictions like lockouts or utility shutoffs.

Why Some Maryland Tenants Still Get Evicted After Paying Rent

Our attorneys at Whitney, LLP often see cases where Maryland tenants were evicted after paying rent due to:

  • Carelessness and bad recordkeeping by landlords.
  • Landlord failing to cancel the eviction with the sheriff’s office after tenant pays.
  • Landlords illegally changing locks, seizing belongings, or cutting off utilities without a court order.

No matter the excuse or reason, if an eviction was performed illegally, tenants have legal rights and can fight back.

Each of these actions may give tenants the right to recover damages with the help of Whitney, LLP’s Maryland eviction lawyers.
