Injured by a Security Guard – $40k Settlement

After our client was injured by a security guard at a Baltimore concert venue, Whitney, LLP’s Maryland security guard injury lawyers recovered a $40,000 settlement.   Unfortunately, incidents where patrons are injured by a security guard are not uncommon.  Maryland law provides important protections and remedies for victims of security guard attacks.  Untrained and overly aggressive security guards are often the cause of injuries and harm to event patrons.  Security guard companies and the venue’s owners and managers can be held responsible for security guard attacks and injuries.

$40,000 Settlement for Client Injured by a Security Guard at Patapsco Arena

Our client attended a concert at Patapsco Arena in Baltimore in October 2022. After waiting in line for nearly ninety minutes, a crowd surge pushed our client toward the entrance and into security guards.  Our client alleged the following: that despite clearly indicating to security that he was not responsible for the pushing, he was sprayed with pepper spray by security guards; and that as he tried to recover, he was aggressively confronted and chased by a security guard who struck him multiple times and slammed him onto a vehicle.

Video footage captured the guards chasing our client and hitting him even as our client tried to escape.

Our client went to Patient First and was treated for minor bruising and contusions.  He made a full recovery, but remained very upset at what he felt was an unprovoked attached.  HIs legal claims included negligence, assault and battery.  His claimed damages for his physical injury to his head, neck, arms, and back, and emotional distress including anxiety, worry and embarrassment.

This is a textbook example of a patron being injured by a security guard who allegedly failed to exercise proper judgment and restraint.

After filing the lawsuit, Whitney, LLP recovered the $40,000 security guard injury settlement.  The security guard company and the owner of the arena denied liability.  Of course all cases are different, and past results do not guarantee future results.

Untrained Security Guards: A Serious Threat to Safety

Starting January 1, 2025, Maryland requires all businesses employing security guards or in-house loss prevention personnel to comply with new licensing and certification standards and to provide proof of insurance.

Untrained security guards create significant risks to public safety, property, and the reputation of businesses that employ them. Without adequate training, these guards often lack the skills needed to de-escalate conflicts, recognize threats, or respond appropriately in emergencies, which can lead to disastrous outcomes such as unnecessary violence and serious injury.  For example, untrained guards may panic or overreact during stressful situations, resorting to excessive force or making critical errors in judgment that escalate rather than resolve incidents.

This lack of preparedness is a danger to the public and also exposes employers to legal and financial liability if someone is harmed as a result of a guard’s actions. As seen in recent lawsuits, including those involving Maryland event venues, the consequences of employing untrained security personnel can be severe—ranging from physical assaults on innocent patrons to lasting emotional trauma.
