Maryland Trash Out Illegal Eviction $225k Settlement

How Our Client Was Illegally Evicted

Our client lived alone and had experienced personal hardships, including serious medical conditions. After falling behind on rent, the landlord filed a Failure to Pay Rent case. But under Maryland law, a tenant has the right of redemption—the ability to stop an eviction by paying the full judgment amount before the sheriff arrives.

That is exactly what happened here. Our client paid the full balance due after a judgment was obtained by the landlord for the late rent.  Weeks later, however, the landlord went ahead with the eviction anyway in a mistaken eviction.

When our client came home, her belongings were thrown outside with some stolen and broken. The landlord referred to the illegal lockout as a “trash-out eviction,” as if our client’s home and possessions were garbage. The Landlord Called It a “Trash-Out Eviction”

Adding insult to injury, the landlord repeatedly called the incident a “trash-out eviction.” In the property management industry, a “trash-out” usually refers to clearing out a unit after a lawful eviction or when a tenant has abandoned a property. Contractors often call these “trash-outs” because they remove whatever “trash” left behind so a landlord can prepare the unit for a new tenant.

But here, our client had not abandoned the apartment. She had exercised her legal right to pay the rent, and she still lived there. Referring to the unlawful lockout as a trash-out eviction was an attempt to disguise what it really was: an illegal eviction under Maryland law.

Maryland courts make it clear: tenants cannot be removed by a landlord calling an eviction a “trash-out.” Only the sheriff may execute a lawful Warrant of Restitution. By labeling this as a trash-out eviction, the landlord tried to lessen their violation of the law.

Maryland Law: Why This Was an Wrongful Eviction

Maryland eviction law prohibits landlords from removing tenants or their belongings without a sheriff carrying out a valid Warrant of Restitution.

Maryland Real Property Title 8, Section 8-216 prohibits landlords from illegally evicting tenants by locking them out or willfully reducing services like heat, water, and electricity to force them to leave. “Willful diminution of services” refers to intentionally stopping essential services with the goal of making the tenant abandon the property. Landlords must use a court order to evict a tenant; they cannot resort to self-help methods to regain possession of a rental property, except in the event their tenant abandons or surrenders the Apartment.

When a tenant has already paid what is owed, the landlord has no legal right to evict.  The exception is that “if you have had three (3) judgments of possession against you (or four(4) in Baltimore City) during the past 12 months before the current suit, a landlord may ask the court to deny your right to redeem the property.”

Despite this, the landlord in this case ignored Maryland’s clear laws and tried to excuse it by calling it a trash-out eviction.
