Annapolis Apartment Infested With Bed Bugs

Hi, this is Dan Whitney with the Whitney Law Firm in Towson, Maryland. Today, we’re going to talk about a bed bug case settlement in Annapolis, Maryland that occurred after a young woman was moved into a bed bug infested apartment. So I have experience with bed bug issues, because I’m an attorney here in Maryland and I’ve handled bed bug cases and bed bug injury cases for about 10 years. And a lot of those cases involve a tenant moving into a new apartment and finding a bed bug infestation.
The Landlord is Responsible for Bed Bug Infestations
Once that infestation is reported to the management company, what happens a lot of times is the management company will hire an ineffective pest control company to treat. Of course, if they’re ineffective, that means they do not properly treat the infestation, the infestation persists.
And what happens is not only the tenant in that unit continues to see bed bugs and get bitten and have a miserable time, it also means the adjacent units either had caused the infestation to spread into my client’s unit, or the infestation that was in her unit now spreads to the other units and just really worsens the problem for everyone in the building.
Finding Bed Bugs After Bed Bug Inspections
So in this scenario, a young woman moves in and reports the problem to the landlord. The landlord hires a pest control company that comes out approximately four times. They search for an infestation. They don’t find an infestation, yet our client continues to actually catch the bugs herself. And of course, she’s said no training as a pest control technician. She catches the bugs. The negligent pest control company is supposedly unable to find the infestation, and our client’s misery continues for several months.
Eventually, she moves out of the apartment and contacts us at the Whitney Law Firm, and we ended up bringing a lawsuit on her behalf. And after the suit’s filed, we get some discovery information from both the pest control company and the landlord.
Negligent Landlord Ignores Bed Bug Complaints
It turns out that she had been making complaints and she had been providing proof of the infestation to the landlord. And despite her providing proof in the form of videos and photographs of the bed bugs, the landlord and the pest control company said they were not finding any bed bugs and there’s no need to treat, which of course is absurd if the tenant is finding the infestation. So as a result of this, she had a very miserable about three or four months before she moved out. And she was bitten as a result of this.
Bed Bug Lawsuit Filed Against Annapolis Landlord
Now, after the suit was filed, we ended up settling the case for over $50,000, and she was able to get enough compensation to replace some of the property she discarded, and of course, for the bed bug bites and emotional distress.
