History of Infested Hotel Rooms
About two months prior to our clients’ arrival, the Hotel was informed by a prior guest, who stayed in the same room, that the beds were massively infested with bed bugs. The Hotel’s pest control company confirmed the infestation and recommended treatment. Yet the room received no professional treatment and was rented to unsuspecting guests who expected a clean room free of infestation.
When a hotel is placed on notice of an existing bed bug infestation, yet chooses to take no action, they face significant liability when future guests are bitten. An experienced bed bug claim lawyer, such as those with Whitney, LLP, can maximize guest claims for compensation.
Entire Floor of Hotel Infested
From prior litigation, Whitney, LLP knew that this particular Hotel had a history of dealing with guests in a deceitful and callous manner. For instance, guests complaining of bed bugs were told that the Hotel takes bed bugs seriously, has never found any serious pest issues, and that any isolated instances were very rare. Yet this same Hotel actually had every room on an entire floor infested with bed bugs, and professional treatment by a licensed pest control contractor was cancelled in favor of inept self help measures that the manager knew would be ineffective.
The Hotel owner vetoed professional treatment in order to save money and not cut into the Hotel’s profit margin. Properly dealing with and treating infested hotel rooms can be very expensive for property managers, who often seek to keep costs down at the expense of their guests.
Similar Prior Bed Bug Settlement Against Same Hotel
Despite Whitney, LLP representing other guests at the same hotel, and obtaining a significant settlement to resolve a prior bed bug lawsuit against this same Hotel, the Hotel owner unfortunately failed to implement a reasonable bed bug policy to protect guests from lodging in bed bug infested rooms. Building upon Whitney, LLP’s bed bug settlement database from the prior lawsuit, the firm was able to secure a $175,000 settlement. For its continued indifference, compared to the earlier settlement, the Hotel ended up paying an extra $100,000.
